SECTION 1 - LICENSE
You, the end user, are granted a limited, non-exclusive license to use the software, programs and/or files
and the media on which it is contained (the "Licensed Materials"). You do not obtain title to the Licensed
Materials or any copyrights, or proprietary rights in the Licensed Materials. You may make backup copies for
archival purposes only.
Bitwise Internet Technologies, Inc. grants you the right to use one copy of the Licensed Materials on any
single computer, provided the Licensed Materials are in use only one computer at any time. For the purposes
of this license, "use" means loading any or all of the Licensed Materials into the temporary memory (i.e. "RAM")
or the installation of the Licensed Materials into the permanent memory (i.e. CD-ROM, hard disk, or other
permanent storage device) of that computer. A copy of the Licensed Materials installed on a network server
for the sole purpose of distribution to other computers is not considered "in use". If you install a copy of
the Licensed Materials on a network server for the purpose of distribution to other computers you must have in
place a reasonable mechanism to ensure that the number of persons using the Licensed Materials at any one time
does not exceed your current number of licenses.
SECTION 2 - COPYRIGHT AND ALLOWED USE
The Licensed Materials are owned by Bitwise Internet Technologies, Inc. and are protected by United States
copyright laws and international treaty provisions. The Licensed Materials must be treated like any other
copyrighted material except that you may distribute the electronic art images in this collection freely and
without any royalty payments or ownership credits, provided that (a) you do not include any of the electronic
art images in any collection of art either in electronic or any other format or medium which is either freely
distributed or sold for a fee, (b) do not represent any of the electronic images as your own creation or
copyright, (c) do not charge a fee to any third party for any of the electronic art images, (d) only
distribute any of the electronic art images as component parts of greater works of your own creation
(e.g. as artwork utilized by a Hypertext Markup Language (HTML) file), (e) you do not distribute or
utilize any of the images which are trademarks or registered trademarks of Bitwise Internet Technologies, Inc.
or any other company.
SECTION 3 - WARRANTY & GENERAL
The Licensed Materials are provided "as is." All warranties and representations of any kind with regard to
the Licensed Materials are hereby disclaimed, including the implied warranties of merchantability and fitness
for a particular purpose. Under no circumstances will the manufacturer or developer of the Licensed Materials
be liable for any consequential, incidental, special, or exemplary damages even if apprised of the likelihood
of such damages occurring. Some states do not allow the limitation or exclusion of liability for incidental
or consequential damages, so the above limitation may not apply to you. The media are warranted for 30 days
from date of purchase.
This Agreement is governed by the laws of the Commonwealth of Massachusetts.
